1. Acceptance of Terms

By accessing or using the Memoryan mobile application, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using or accessing this app.

2. Description of Service

Memoryan is a personal content organization application that allows you to save, organize, and recall digital content including links, notes, images, and other media. The app operates primarily on your local device with optional cloud synchronization features.

3. User Accounts

To use certain features of the app, you must create an account. You are responsible for:

• Maintaining the confidentiality of your account information
• All activities that occur under your account
• Providing accurate and complete information
• Promptly updating your account information
• Notifying us of any unauthorized use of your account

4. User Content & Responsibility

You retain ownership of all content you create or upload to the app. You are solely responsible for:

• The content you store in the app
• Ensuring you have rights to any content you save
• Compliance with applicable laws and regulations
• Backing up your important data
• The consequences of any content you share or make public

We do not monitor, review, or take responsibility for user content.

5. Acceptable Use

You agree not to use the app to:

• Store or share illegal, harmful, or offensive content
• Violate any intellectual property rights
• Attempt to gain unauthorized access to our systems
• Use automated means to access the app without permission
• Interfere with or disrupt the app or servers
• Impersonate others or provide false information
• Distribute malware or harmful code

6. Intellectual Property

The app, including all software, designs, graphics, and content created by us, is protected by copyright, trademark, and other intellectual property laws. You may not:

• Copy, modify, or distribute our proprietary content
• Reverse engineer or attempt to extract source code

7. Premium Services & Billing

Premium features may require a subscription. By subscribing, you agree that:

• Billing occurs through your app store account
• Subscriptions automatically renew unless canceled
• You must cancel at least 24 hours before renewal
• Refunds are subject to app store policies
• We may change pricing with advance notice
• Premium features may be modified or discontinued

8. Data & Privacy

Your privacy is important to us. Our data practices are governed by our Privacy Policy, which is incorporated into these terms. Key points:

11. Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of data or content
• Loss of profits or business opportunities
• Service interruptions
• Third-party actions or content

Our total liability shall not exceed the amount paid by you for premium services in the past 12 months.

12. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, or expenses arising from:

• Your use of the app
• Your violation of these terms
• Your content or activities
• Your violation of any third-party rights

13. Termination

We may terminate or suspend your account and access to the app at our sole discretion, without notice, for conduct that we believe violates these terms or is harmful to others. Upon termination:

• Your right to use the app ceases immediately
• You may lose access to your account and data
• We may delete your account and associated data
• You remain liable for any outstanding obligations

14. Governing Law

These terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law provisions. Any disputes shall be resolved through binding arbitration or in courts of competent jurisdiction.

15. Changes to Terms

We reserve the right to modify these terms at any time. We will provide notification of material changes through the app or via email. Continued use of the app after changes constitutes acceptance of the updated terms.

16. Severability

If any provision of these terms is found to be unenforceable, the remaining provisions shall remain in full force and effect. The unenforceable provision shall be replaced with an enforceable provision that most closely reflects our intent.

17. Account Deletion & Data Retention

You have the right to delete your account at any time. Here's what you need to know about the account deletion process:

How to Delete Your Account:

1. Open the Memoryan app on your mobile device
2. Navigate to Profile → Tap the profile icon in the bottom navigation
3. Go to Account → Tap the account button in the top of the profile page
4. Scroll to Bottom → Look for the "Delete Account" button at the bottom
5. Follow the Deletion Process → Complete the required steps

Account Deletion Process:

• Reason Selection: You'll be asked to select a reason for deletion (optional feedback)
• Experience Feedback: Optional feedback about your experience with the app
• Password Confirmation: Enter your current password to confirm the deletion
• Acknowledgment: Confirm that you understand the deletion is permanent
• Final Confirmation: Tap "Delete My Account" to initiate the process

Grace Period & Data Retention:

• 30-Day Grace Period: Your account and data will be retained for 30 days after deletion request
• Account Recovery: During the 30-day period, you can contact us to recover your account by email: info@mymemoryan.com
• Permanent Deletion: After 30 days, your account and all associated data will be permanently deleted
• No Recovery: Once the 30-day period expires, account recovery is not possible
• Immediate Logout: You will be immediately logged out when deletion is initiated

What Gets Deleted:

• Your user account and profile information
• All chambers (folders) and their contents
• All blocks (saved content, notes, links)
• All personal settings and preferences
• All sync data stored in the cloud
• All associated metadata and usage analytics

Important Notes:

• Irreversible: Account deletion cannot be undone after the 30-day grace period
• Local Data: Data stored locally on your device should be manually cleared
• Backup: We recommend exporting important data before deletion
• Subscriptions: Cancel any active subscriptions separately through your app store
